Breaking: Scientology Leader David Miscavige Files To Have Presiding Judge Removed From Leah Remini Lawsuit
The motion, filed yesterday by Miscavige's personal attorney, seeks to remove the Los Angeles Judge who just ruled that the organization Miscavige controls will remain a party to the suit.
David Miscavige, the autocratic leader of Scientology, has filed a motion with the LA Superior Court to have the judge presiding over the lawsuit Leah Remini filed last August removed.
The motion, a Peremptory Challenge to Judicial Officer, was filed with the court on behalf of David Miscavige yesterday.
The motion says that Miscavige believes that the judge presiding over the case, Randolph Hammock, is "prejudiced against the party (or his or her attorney) or the interest of the party (or his or her attorney), so that declarant cannot, or believes that he or she cannot, have a fair and impartial trial or hearing before the judicial officer."
The lawsuit against Miscavige, the Church of Scientology International, and the Religious Technology Center, the organization he controls, which in turn controls Scientology's vast web of global organizations and assets, was filed last August by Remini.
Miscavige's motion comes after Hammock ruled that the Religious Technology Center (RTC) would continue to remain a party in the suit despite Scientology's attorneys and David Miscavige's attorneys going to great lengths to have RTC and Miscavige removed.
Scientology has a long history of falsely claiming that its leaders (L. Ron Hubbard, whom David Miscavige succeeded) only serve as ecclesial leaders of Scientology, which operates like a borderless totalitarian state and the cult of personality, and have no control or oversight over Scientology’s financial affairs and the activities of its global intelligence agency (the Guardian’s Office under Hubbard and the Office of Special Affairs under Miscavige).
That is a lie in Hubbard's case and even more so in Miscavige's case.
Miscavige maintains absolute control over all Scientology organizations and their assets. He ruthlessly, and sometimes violently, micromanages their operations.
This motion is the first time that Miscavige or Scientology has sought to change the judge in the suit. Last fall, Remini filed to get a new judge assigned to her case, resulting in Hammock presiding.
Remini filed a lawsuit against the Church of Scientology International, the Religious Technology Center, and David Miscavige personally last August.
Remini's lawsuit contained significant allegations of harassment, illegal surveillance, defamation, and interference in her business contracts, among many other allegations. Her suit was filed after years of non-stop malign activity by Scientology, its operatives, and agents. Remini was a member of Scientology from the time she was eight years old until she escaped with her family in 2013.

Jeffrey Riffer, the Los Angeles attorney who filed the motion on behalf of Miscavige, has long represented Miscavige on a personal basis.
Riffer was also the attorney who accompanied a woman who said she was Shelly Miscavige to meet with LAPD detectives at a coffee shop in the Los Angeles area after Remini had filed a missing person's report. During that meeting, LAPD detectives took impressions of the woman’s fingerprints and compared them to prints on file with the California DMV. The LAPD forensics lab determined that the prints from the woman claiming to be Shelly Miscavige were unsuitable for a match.
Instead of seeking a new set of prints from Shelly, LAPD detectives closed the missing person's case and announced, without evidence, that Remini's report was "unfounded."

Miscavige needs to be held accountable for all the atrocities that have occurred under his reign of terror. I'm one of the lucky ones that got away when they tried to brainwash me, after locking me in a windowless room for hours, and pressuring me to join the Sea Org (I was only 16). It pains me to think of the kids that were not as lucky. I applaud Leah for her bravery and integrity.
